The General Terms and Conditions as stated here apply to all products offered in the Alfia Belgian Bitter webshop and to all deliveries. Each order implies acceptance of these general terms and conditions of sale. The customer has the right to inform the seller of the cancellation of the purchase within 7 calendar days after delivery of the goods or the conclusion of the agreement, without penalty and without giving reasons. Only Belgian law applies to the General Terms and Conditions of Studio 709.

DEFINITIONS Working days: all calendar days except Saturdays, Sundays and public holidays.

PURCHASE AND PAYMENT The agreement between Studio 709 and the buyer is concluded as soon as the buyer has accepted the conditions set by Studio 709. The absence of a traditional signature does not affect the binding nature of the offer and its acceptance. Studio 709 reserves the right to refuse an order or to subject it to additional conditions, for example in the case of large orders, orders by minors, or if the ordering procedures have not been fully completed or previous orders have caused problems. Studio 709 always confirms the order by e-mail. If the customer has not received a confirmation e-mail, the order is not valid. Payments for products purchased from Studio 709 can only be made via the available payment methods. The seller remains the owner of the goods until payment has been completed. If a payment is not made on time, Studio 709 has the right to immediately cancel the agreement or to postpone the (further) delivery of the goods until full payment has been received. The General Terms and Conditions and confirmation emails are always displayed in the language of the website.

DELIVERY AND DELIVERY TIME The delivery times stated by Studio 709 are approximate and do not constitute binding terms. The final delivery period is 30 days after receipt of the order, except in the case of payment by bank transfer: in that case the final delivery period is 30 days after receipt of payment. As soon as the goods have been delivered to the delivery address, the buyer bears the risk for these products. The general terms and conditions may differ for deliveries abroad. Studio 709 delivers to the following country: Belgium, Germany, France, Luxemburg and The Netherlands. Deliveries are only carried out via a courier service, unless otherwise agreed prior to the agreement. The contact details of the courier service can be found on the relevant websites.

You will be informed of the shipping and delivery costs before confirmation of your purchase. If the shipping costs cannot be calculated automatically, this will be stated and/or an estimate of the shipping costs will be provided.

PRODUCT INFORMATION Studio 709 strives to provide the most accurate information, images, verbal explanations and price quotes possible about the goods offered and their most important characteristics. Studio 709 accepts no liability for advice, printing errors on the website or technical information provided by suppliers or manufacturers. The availability of each product is indicated. Although Studio 709 strives to provide correct information, it is possible that products cannot be delivered due to incorrect stock data or problems with suppliers. In that case, Studio 709 will contact you as soon as possible to offer a solution.

The products offered by Studio 709 comply with the legal standards and can be sold online. It is possible that the Studio 709 website contains links to other sites that may be interesting or informative to the visitor. These links are for information purposes only. Studio 709 is not responsible for the content of these sites or for their use.

REFLECTION PERIOD AND RETURNS (DISTANCE PURCHASING ACT)

The Belgian Act on Trade Practices, Information and Consumer Protection of 12 April 2010, gives the buyer a reflection period of 14 calendar days for all products purchased from Studio 709. This period starts as soon as you or someone on your behalf has received the goods. We expect you to handle the goods and packaging with care during this period. The right to cancel the purchase lapses if the product or packaging is damaged, used or not in its original condition. If you wish to cancel the purchase, you must inform us within 14 calendar days after delivery of the goods by telephone or in writing. Cancellation of the purchase is without penalty and without giving reasons.

The goods must be returned undamaged, unused and unopened (in original packaging) no later than 14 days after delivery. The shipping date is considered a check. All documentation, warranty certificates and packaging materials must be enclosed, as well as your bank account number. The shipping costs of the return shipment are for the account of the buyer.

Unstamped shipments (or shipments with unreadable postage) will be refused and returned to the sender. Studio 709 will refund the full purchase price and the initial shipping costs within 30 days of receipt of the return shipment. If the goods are not returned in accordance with the terms of the right of withdrawal, the purchase price including shipping costs will not or only partially be refunded. In that case, the product remains your property. Upon request, the product can be returned to you, subject to payment of the shipping costs.

Exceptions to the above conditions: If a product has been specially made or customized for you, the 14-day right of withdrawal does not apply. Refunds are not possible if a product has been worn, used or otherwise damaged.

WARRANTY CONDITIONS Studio 709 applies the official warranty conditions of its suppliers. Studio 709 is responsible for handling warranty cases, with the exception of the shipping costs for returning the product.

COMPLAINTS/DEFECTS The customer is obliged to thoroughly check the delivered goods immediately upon receipt. He/she must check whether the delivered goods are in accordance with the agreement:

• Have the correct products been delivered?

• Do the delivered products meet the agreed quality requirements or, if these are lacking, the standards for normal use of the product?

An obvious defect must be reported to Studio 709 within 7 working days after delivery. A hidden defect must be reported in writing by e-mail within 2 working days after discovery, at the latest 2 months after delivery of the product. The costs for returning goods that do not meet the description of the offer will be borne by Studio 709.

FORCE MAJEURE This concerns all external causes, foreseen or unforeseen, over which Studio 709 has no influence but which prevent Studio 709 from fulfilling its obligations. Studio 709 has the right to invoke force majeure if the circumstances that make fulfillment of the obligations impossible occur after the moment when Studio 709 should have fulfilled its obligations. In such a case, the delivery and other obligations of Studio 709 are suspended. If this period lasts longer than 8 weeks, both parties can terminate the agreement without any obligation to pay damages.

PRICES Before completing the payment, you will be informed of the price of the goods. All prices are in euros and include VAT, Recupel, Bebat and Reprobel. Shipping costs are stated separately. An agreed price does not exclude the right of Studio 709 to increase the price. Offers are valid while stocks last. If a price increase occurs after the conclusion of the agreement, the customer can cancel the agreement, regardless of the percentage of the increase. A personal quote is valid for 2 weeks, unless otherwise stated on the quote.

INTELLECTUAL PROPERTY RIGHTS The content of this site, including brands, logos, drawings, data, product or company names, texts and images, is protected by intellectual property rights and belongs to Studio 709 or entitled third parties.

QUESTIONS AND COMPLAINTS Complaints and disputes must be reported within 7 days of delivery. If a complaint is found to be justified, our liability is limited to exchanging the goods. The seller's liability is limited to the amount of the order. Studio 709 will handle questions or complaints within a reasonable period of 7 calendar days.

DISPUTES All offers and agreements are exclusively governed by Belgian law, without taking into account any principles of private international law. All disputes arising from offers or agreements with Studio 709 will be submitted to the competent court of Leuven, unless a mandatory legal provision designates another competent jurisdiction.

LIMITATION OF LIABILITY The information on the website is of a general nature and not adapted to personal or specific circumstances, and can therefore not be considered as personal, professional or legal advice to the client. Studio 709 strives to provide correct, accurate and up-to-date information. Despite these efforts, inaccuracies may occur in the information provided.
